other arterial routes — have pavement that is in substandard condition and provides an unacceptably rough ride to drivers. It says 47 percent of roads in Oklahoma City and 46 percent of roads in Tulsa are in poor condition.By Alex Cameron, Oklahoma Impact Team OKLAHOMA CITY — Oklahoma officials are counting on several things to ensure that federal stimulus dollars are not wasted or spent fraudulently in the state — a watchdog state auditor, detailed reporting requirements, and a web site that puts that reporting on display. The state is also counting on one more thing, its citizens. With about $3 billion in American Recovery and Reinvestment Act funds beginning to spread out across the state, law enforcement officials decided it madesense to give people across the state an easy way report any misuse of those funds. And so it was with some fanfare that, in June, the state’s three U.S. Attorneys, the top man at the FBI, and the state Auditor and Inspector announced they had created a statewide fraud hotline. And yet just over four months later, those same everyday citizens said they were unaware a hotline even existed. “No, I didn’t even know we had that. It’s a good idea, though,” said one citizen when asked if they knew about the statewide fraud hotline. Officials in the U.S. Attorney’s office said the reason for the hotline is to give law enforcement one more avenue for preventing fraud, abuse, or waste of stimulus money. “We believe, much like, I think, most Oklahomans believe, this is taxpayer money and we want to see it work for that purpose for which it was intended,” said Bob Troester, acting U.S. Attorney for the Western District of Oklahoma. But with so much taxpayer money being funneled into so many projects in such a short period of time, federal officials said they know the opportunity for fraud is significant. “There’s the opportunity for kickbacks or payoffs of some kind, preferential treatment of some kind,” said Oklahoma City FBI Special Agent in Charge, James E. Finch. FBI officials agreed to set up and man the hotline in their Communications Center. So far, the calls have been sparse. “There have been a couple of calls,” Finch said. “In terms of where those calls led, did they lead to cases being opened? At this point, I can’t really say.” Troester echoed that statement. “At this point, I’m not at liberty to comment on any of the individual reports,” Troester said. Troester did say that he and his counterparts in the eastern and northern districts are committed to aggressively prosecuting fraud, if they find it, just as they did after Hurricane Katrina when some Oklahomans fraudulently obtained relief intended for the Gulf Coast. “And those dollars didn’t even come to Oklahoma. Those dollars were intended for victims of Katrina,” Troester said. Now, with stimulus dollars seemingly everywhere, law enforcers said they have to be more vigilant in preventing fraud, waste and abuse. “You can rest assured the government’s pretty serious about protecting its interest, the taxpayer dollars,” Finch said. Finch said an important part of that protection is the fraud hotline. Everyday citizens said they agree. “I think it’s excellent, because I do think there’s a possibility for fraud if there’s nobody checking and holding people accountable,” said a concerned citizen. Sheldon Sperling, U.S. Attorney for the Eastern District of Oklahoma, hopes people will become more familiar with the hotline number, 1-877-259-7337. But Sperling also said he hopes, if people are trying to report waste or fraud, but can’t remember that number, that they will call or him directly. What’s more, he said, if he’s not available, then call or Bob Boese, who works as the U.S. Attorney for the Eastern District of Oklahoma office’s law enforcement coordinator.OKLAHOMA CITY (AP) – A new federal report indicates that Oklahomans will be able to choose from an average of 53 qualified health care plans under the health insurance exchange scheduled to begin next week. The report, made public Wednesday by the U.S. Department of Health and Human Services, says monthly premiums in Oklahoma will range from $266 for one type of plan to $174 for another before subsidies are applied. The federally run health insurance marketplace opens Tuesday in Oklahoma. Last year, Gov. Mary Fallin rejected a state-based insurance exchange under the new health care overhaul law. Fallin also turned down an expansion of Medicaid to provide coverage to thousands of low-income, uninsured citizens. Insurance Commissioner John Doak has predicted that health insurance rates under the new law would increase over current rates. Copyright 2013 The Associated Press. All rights reserved. The question is, by how much? It’s something that officials and scientists meeting in Stockholm will try to pin down as precisely possible Friday in a seminal report on global warming. Future global warming levels depend on two major factors. One is how much more carbon dioxide (CO2) and other greenhouse gases are pumped into the air and how quickly. The other is the rate at which those gases cause warming, sort of like a revving car engine. With that rate, called “climate sensitivity,” scientists are trying to figure out how much warming would happen with different levels of carbon pollution. The higher the climate sensitivity or rate, the higher the warming per ton of greenhouse gas emitted. The values adopted by the Intergovernmental Panel on Climate Change are important because they could affect how hard governments try to rein in CO2 emissions – which are still going up largely due to the rapid expansion of China and other emerging economies. A lower value may reduce the world’s sense of urgency in making a costly energy transformation from oil, coal and gas to renewable sources like solar or wind power – or in halting the destruction of the Earth’s forests, which capture CO2. “It’s a key part of the climate problem,” said Chris Field, a Carnegie Institution scientist who is a leader in the IPCC but wasn’t involved in the report due Friday. The greenhouse effect, which explains how CO2 and other greenhouse gases trap heat in the atmosphere, was discovered in the 19th century but scientists are still struggling to quantify it. The IPCC is expected to say Friday that it’s 95 percent certain that more than half the surface warming of the Earth that has been observed since 1951 is due to the CO2 emissions resulting from human activities. Climate sensitivity is a measure of how much temperatures would go up if the concentration of CO2 doubled in the atmosphere. In its third assessment, the IPCC estimated this as a likely range of 1.5-4.5 degrees Celsius (2.7-8.1 Fahrenheit). The fourth report, in 2007, raised the lower end of that range to 2 C (3.6 F), and gave a best estimate of 3 C (5.4 F). Now, new research has shown that the upward move may have been too hasty, and there’s a discussion in Stockholm over whether to bring the lower end back down to 1.5 C (2.7 F). It may seem like a minor detail, but it makes a difference to governments, which want to know how much CO2 emissions need to be cut to prevent temperatures from increasing more than 2 C (3.6 F) compared to before humans started burning fossil fuels. That’s the limit they have agreed to in U.N. climate talks. Temperatures have already gone up about 0.8 C (1.4 F). Reducing the lower range of climate sensitivity “would mean that we have a better chance of staying below 2 degrees than we thought before,” said Kaisa Kosonen, a Greenpeace climate activist. “But I wouldn’t bet on it because they are not lowering the higher end of the range.” In leaked comments on a June draft of the IPCC report, the British government called climate sensitivity “a key issue of concern” that helps give policy-makers a sense of how big a threat climate change is. The United States, Australia and Norway have called for the authors to provide a single value as their best estimate in addition to a range, to give policy-makers better guidance. Meanwhile, EU climate commissioner Connie Hedegaard is downplaying the discussion. “You don’t need to have the last decimal to see that the overall number isn’t looking good,” she said in a comment emailed by her spokesman. Some scientists resist giving a single value because it could give the false impression that there’s more certainty than there really is about how sensitive the climate is to CO2. That doesn’t mean they doubt that CO2 serves as an engine of warming – the question is whether it’s a four-cylinder or a V8. “We know a great deal of the mechanism by which CO2 causes warming,” said Field, the Carnegie scientist. “There is still uncertainty about how much a range of feedbacks either amplify or suppress that warming.” Copyright 2013 The Associated Press. The report was released on Wednesday by the Center for American Progress, a Washington, D.C.,-based non-partisan research and educational institute. The report, entitled The State of Woman in America, says Oklahoma women suffer from the third-highest maternal mortality rate in the nation. That means women in Oklahoma are more likely to die from pregnancy-related medical complications than women in 47 other states. The report also says Oklahoma is among the top 10 worst states in the nation in terms of infant mortality. Across the nation, the state has the second-lowest rate of OB-GYNs to the female population, with only one OB-GYN for every 18,713 women. Copyright 2013 The Associated Press. All rights reserved. Joe Dorman has released the findings from a statewide survey on school storm shelters, and the report paints a dangerous picture for hundreds of thousands students, teachers and staff.Dorman commissioned the interim legislative study to determine which schools have storm shelters or safe areas, and which do not. The data was collected by Bar None Consulting and analyzed by Safe Design Group. The statewide survey, released Thursday morning, indicates 506,000 students, teachers, and staff are not protected from severe weather, such as the May 20 EF5 tornado that killed seven students at Plaza Towers Elementary School in Moore. “It is absolutely unacceptable that Oklahoma lawmakers have failed to address the safety of students and teachers in our public schools,” said Dorman. “It is reprehensible to think that every day the state fails to act on placing storm shelters in public schools, we put the lives of more than a half a million children, teachers and school staff in peril.”The survey did find that nearly 39 percent of Oklahoma public schools have some type of shelter area; but more than 61 percent have no refuge or safe area of any kind.Of the 695 schools that have a shelter area, only 271 schools have a storm shelter that is designed to withstand 250 mph winds. The report looked into the five-year new construction and remodeling plans that schools are already considering. The survey found if Oklahoma schools did nothing more than incorporate storm shelter construction into their planned construction over the next five years, 33 percent of the schools currently without shelters would join the ranks of those with shelters, increasing the number of schools with a shelter to 1,065, or 59 percent of Oklahoma public schools.A legislative committee will meet October 31 to discuss the survey’s findings.By Kathleen DohenyHealthDay ReporterTUESDAY, Sept. 17 (HealthDay News) — Nearly 14 million people in the United States, or one in 23, are now cancer survivors. In comparison, only 3 million people, or one in 69, were cancer survivors in 1971, according to the third annual cancer progress report, issued Tuesday, by the American Association for Cancer Research (AACR).While there are increasing numbers of cancer patients because some cancers are more common with age, “there is a large increase in the number of survivors,” said AACR President Dr. Charles Sawyers. “That’s a return on our investment in cancer research.”Sawyers, who chaired the report writing committee, is also an investigator for the Howard Hughes Medical Institute, and chair of the human oncology and pathogenesis program at the Memorial Sloan-Kettering Cancer Center, in New York City.Other noteworthy advances, Sawyers said, is the approval of 11 new anticancer drugs in the past year alone, which he called “amazing.” Also of note is the evolution of immune system modifiers for cancer, such as drugs for certain lymphomas and multiple myeloma, that rev up the immune system to fight the cancer. “Science is paying off, finally,” he said. From 1990 through 2012, more than 1 million lives have been saved from cancer, according to the report.”The progress is astonishing,” said Dr. Cy Stein, a distinguished professor and chair of medical oncology and experimental therapeutics at the City of Hope Comprehensive Cancer Center in Duarte, Calif.”Things have been getting better. That is the truth of this report,” said Stein, who is also deputy director of clinical research at City of Hope. He was not involved in the report.Among the successes noted in the report are that the five-year survival rates for women diagnosed with invasive breast cancer have increased from 75 percent in the mid-1970s to 90 percent or more now.For children diagnosed with acute lymphocytic leukemia, the five-year survival rates have increased from 58 percent to 90 percent or greater during the same time period. But the progress has not been uniform for all cancers. For instance, the five-year survival rates for some cancers, including the aggressive brain cancer known as glioblastoma multiforme, as well as liver, lung and pancreatic cancers, have not improved much over more than 40 years, with survival rates of 4 percent to 16 percent.Despite the progress, more than 1.6 million Americans are expected to be diagnosed with cancer this year and more than 580,000 deaths are expected from cancer in 2013. Experts say the number will increase dramatically in the next two decades, largely due to the aging of the population, and cancer becoming more common with age. Most cancers are detected in those age 65 and above, and this part of the population is growing quickly. However, up to 50 percent of cancer deaths are related to preventable causes, including smoking, being obese or overweight, being sedentary and eating a poor diet, the report noted. “The average person would be surprised by how much cancer is preventable, ” Sawyers said. While smoking’s link to cancer is well known, he said that many people remain unaware of the obesity-cancer connection. Obesity increases the risk for many cancers, such as esophageal, colorectal, endometrial, kidney and pancreatic cancers, and breast cancers in women past menopause.Continued progress is jeopardized by the slashing of research funds, the report said. Earlier this year, the U.S. National Institutes of Health’s budget was cut by $1.6 billion — or more than 5 percent. While the report covers a lot of ground, City of Hope’s Stein said the authors didn’t emphasize an important fact: “That people with cancer live better.”"A lot of times, even those with advanced cancer on therapy are able to engage in everyday activities,” Stein said. “A lot of that is [due to] the research that we did a long time ago that has been paying off for a long time.” More informationTo learn more about cancer prevention through living healthy, visit the .Copyright ? 2013 . Yahoo! reports that the Thunder is the frontrunner to sign former Miami Heat sharpshooter Mike Miller. The 13-year veteran and former Florida Gator was a key role player for the Heat’s back-to-back NBA Championships. Miller shot 41.7 percent from 3-point range for Miami last season and 45.3 percent the season before. If Miller and the Thunder do indeed come to terms, he will be utilized as a 3-point specialist as OKC looks to fill the scoring void left by the departing Kevin Martin. The defendant desperately triedto get him back and try to get him back from his wife. The defendant called and texted him, showed up in hugounannounced, and even went to visit his parents. The defendant went so far to say she was pregnant with Holbrook’schild but that didn’t work either. In Jan 2010, she gave up and finally settled back in with KeithBryan but her feelings for Holbrook would never go away. They would erupt 18 monthslater in Sept 2011, the same day Keith Bryan would die.On September 20, 2011, Bryan was shot inside his home in Mustangaround 10 p.m.Becky Bryan had been in Tulsa that day without her husband Keith. She was alone and during this time she took it upon herself toseek out other men.It started with a realtor, Karl Oltterman. The voicemails said :Soon I will be inheriting some money and I’m coming to Hugo,Oklahoma. She said this early eveningon the Tuesday Keith Bryan was shot and killed.Later that evening a friend of Becky Bryan, Debbie Proctor comesover. She came over following a blinddate. She had gone to the Chili’s Restaurant and wanted to report back to herfriend how it had gone. She parked her car in driveway and walked around to the back whereBecky Bryan and Keith Bryan were sitting on the back porch drank tea and talkedabout the date, about the President, until something unusual happened.Just out of the blue , Becky reached over to Debbie Proctor andtapped her on the knee and said you need to go.Proctor had never been asked to leave before . Normally, if it got late she would stay the night onthe couch but Proctor. She left from the back patio through house and out thegarageTwo cars were in the driveway and a small pickup truck they alsoowned.Proctor goes home approx. 2 miles from the Bryan residence. Shewalks the dog and makes a sandwich. Its been approx. 45 minutes and she gets acall from Becky.Becky says Keith has been shot come back over 15 minutes earlier – she had called 911 and told police a 25 yearold man wearing a hoodie came in and shot her husband in the head and turned toher and said, sorry he should have hired me.Becky tells police she followed him out and saw what vehicle hewas in, saw the path he was taking, andsays she saw him driving north. When two officers pull up at her house. Becky meets them in thedriveway with no rush to get them inside. When they get inside, they find Keith Bryan with a gunshot wound to thehead. He had a bullet hole above his right ear an exit wound on theopposite side.Keith is still alive and he is still breathing He is rushed to OU Medical Center in OKC. That’s where he would die the next morning around 6 a.m.You will hear from the EMTs that treated the victim. One willtestify about the statements Becky made while he worked on her husband. In one instance she claimed she was seated in a love seat orchair. In another, the paramedicheard that she came out of the bedroom The 911 call happened at 10:07pm, well before 11 p.m. firstresponders took him to hospital but Becky stayed at the house til aroundmidnight.Family and friends were there and they say she was acting in apeculiar manner.People will say she was on the phone most of the time andlaughing. She was concerned about how she would sell her house now that herhusband had been killedEveryone she was speaking to she told he is dead, we are planninga funeral -this was hours before she learned he diedOSBI was requested to assist.Everyone at the house was asked to leave including Becky and herfriends.Becky and her sister, sister’s boyfriend and two other friendsDebbie Proctor and Sharon Valdez were inthe backseat of the car with Becky. The group stopped at Debbie Proctor’s house so they can get sweatpants and flip flops for Becky. On the way to the hospital, Becky tells her friends she had sexwith Wesley Hubert earlier that day. She pulls up pictures of his penis toshow. She also said she contacted Mark Holbrook that day. Becky told everyonein the car she felt bad about what happened but not bad about what happened toher husband but only that she felt bad she had sex with Wes Hubert the same dayher husband was shot. When they get to the hospital, Nichols Hills Firefighters greetBecky. She talks with them for a few minutes before going into the hospital.Becky described for many people the gun that was used. She said itwas a small black handgun. She said it was similar to the gun that was stolen from her sonjust a few weeks before but what she tell them was she owned a gun just likethe one stolen from her son.Becky told Mustang Police and OSBI the intruder was cute, nice andshe wasn’t afraid of him. She said this even though he just shot her husband incold blood. She said she wasn’t afraidof him.She then told investigators the intruder left through the garagedoor and went to his truck. There is a direct path that leads right to the garage from theliving room. The utility room is a good 4 or 5 feet from the garage door. In that utility room is a washer & dryer. The washer was the 1st appliance fromthe door and the dryer was the 2nd.An investigators pulls a blanket from the dryer and a gun fallsout. The gun box would be found between the mattress and box spring ofthe bryan’s bed also found in the blanket was a shell casing, in addition tothat, they found a right handed latex glove. The glove was tested by OSBI. Ithad DNA in it. DNA from the defendant. Also amixture of DNA that had part of victims DNA.Investigators found holes inthat blanket that appeared someone had shot through that blanket and there wasgun residueThey also found a projectile that went through Keith Bryan’s headCriminalist believe the same casing was fired from the gun foundin the dryerDEFENSE OPENING STATEMENTS – Approximately 10:15 amDefense Attorney Gary James :What you hear in these opening statements is not evidence.Becky was a good homemaker, a good mom and provided a good home lifeand was very active in their church. They both taught Sunday school classes and both attended churchregularly. Now,There was a point in time where a marriage hits a rut and as weheard from some of the jurors… kids had grown up and the relationship was nota s strong as it once wasBecky began a relationship with Mark Holbrook in 2009 and movedforward. In fact there was eveninteraction between both of their spouses. BB & KB stopped and hadbreakfast with Holbrook and his wife on the way for a job interview in Texas. Arelationship developed and you will probably see that Holbrook pursued Beckyand said how God brought them together and that God was telling them to betogetherIn January 2010, Becky filed for divorce it was not contentious. Shemoved into a condo in the 500 block of Jacobs. Both Keith and his father hadgone to help becky move in it was an amicable separationThen around April of 2010 – the friends start to seereconciliation. Becky is at fireluncheon dinner and people realize they are back togetherThey continue doing well and were doing well on Sept. 20thYou will hear two different sides, Becky said Keith had re-courtedher. Keith took the blame for a lot of the divorce filing telling people hedidn’t treat her right should have been more attentive, sent her flowers, andthen the two got back togetherKeith told people if i had to go through all of it again I wouldcause its all worth it cause things are good now. Becky said she wasn’t madly in love butthings were good between them. You will hear Becky goes to a seminar you will hear about her textmessages.”It’s those text messages and some of the action with those menthat have brought us here today because there was a rush to judgement in thiscase.”Becky and Keith were sending flirty texts the day of the shootinglike want me to stop and get you something to eat. I’m on my way home. And she said “Are you getting hot and bothered thinking of me inyour council meeting.”On the way home, Becky stops to help her friend debbie proctorfigure out what to wear on date that night.Proctor goes on that date and when she is done she stops by theBryan home. When Proctor got there she parks in driveway she doesn’t rememberif the garage door was up or down when she got to Bryan home. A neighbor saysit was up. She walks around back and Becky says come over and smoke. I thinkyou will see that is something that happened often between these friends.Keith made a fresh pot of ice tea for Becky and they are out backdrinking tea when Proctor shows up. She stays approximately 45 mins, around 930timeframe. She will say nothing was out of the ordinary between the two of themThey talked about the president and politics and Becky was teasinghim saying he looks like Charlie Sheen. They were teasing him how good lookinghe was and at one point Becky tells Proctor its time to get out of here.Becky walks her through the house out through the garage todebbie’s car parked in the driveway.Debbie said there was a light on in the garage when she wentthrough they have pleasantries and debbie proctor leaves. The next thing is a 911 call, made twice. First, by Becky Bryan’s cell phone it cuts out and they loseconnection. The 911 call comes in again from the land line.Becky tells them there had been a shooter she describes them aswearing a hoodie type sweatshirt young man, medium build, white tennis shoes, and stays with that description the whole point of the case.”First time I saw shooter is when he is up on us “she tells themhe receives a gun shot wound to the right headShe consistently made statement that shooter says “he should havef’ing hired me”Well when is the last time Nichols Hills Fire ever hired anybody? She knew it had been 3 or 4 years. Thats where the confusion came from thatmaybe it was meant for Keith Bryant the OKC Fire Chief. There had been aconfusion over that because Becky knew there had not been a hiring in some timeKeith was a handy guy. Everyone knew that. He had a big shop out back. Some neighborswill tell you Keith would build something or out there working in the yard. Hewas currently building a hot tub area. Keith was building a brick wall aroundthe tub. It was a source of jokes around the family. He would tear off a row if it was notstraight and do it again. There was even a cement mixture out and even water in the last rowof bricks on September 20th.Randy Dunbar, a neighbor will tell you two weeks prior to themurder. Dunbar was working in his yard and a man came up to him, approached himin his yard. He was white male, mediumbuild. He asked him do you need any help with any kind of work, specificallylawn work. Dunbar is a little fearful, uneasy about him and the man asked, welldoes any of your neighbor need work being done. Dunbar was not going tovolunteer any neighbors because he was not sure about the guy. What he remember the last of him is going south on owen.. it dead endsor you can turn left to the bryan’s home or right to the other end of thestreet. You can see Keith’s brick work going on from Rose Hill Drive. You are going to hear evidence Keith was outback working on the brick wall at that time. Now you will hear statements about Becky’s demeanor. Some will say she was in shock. Some will say she is laughing. Some will sayshe kept telling people he [keith] is dead – with the shot he took to the headthat is not an unreasonable assumption.Ultimately she went to hospital, but first Becky stayed at thehouse. Mustang Police tested her for gunshot residue and at some point she is told to sit on the back porch. At some point all of the cars become a partof the crime scene. So she calls her sisterGloria Strother [sp?] and her boyfriend, along with Sharon Valdez [sp?] and Debbie Proctor leave to go tohospital. While Becky and friends are at the hospital, the OSBI is at thehouse searching withphotographers, loggers, etc. The Bryan home has a lot of guns- specifically in the bedroom.Well, a glock .40 caliber pistol box isalso found by investigators. You wont see pics of that because OSBI didn’t takepictures, they didn’t think it was necessary. Well, that .40 caliber glock hasnot been found since then.Ultimately, Kent Bryan -Keith Bryan’s son had some burglaries at is house. So Keith gives a gun to his son andultimately kent’s house was broken into and the only thing stolen was the RugerLCP .380 and $100 cash. This [burglary] happened 6 months prior to the shooting. There wasstrife between the Bryans and the Mustang Police because they did not initiallyfingerprint Kent’s house.Eventually, Police come back out and take fingerprint. Oddly 6 months later , the same day ofKeith’s murder, the prints are turned into the OSBI.So, Cami McNeil [Mustang Detective]goes back to hear the 911 calland get reports of Kent’s stolen gun.At some point, an OSBI agent decides he will search, by himself,in the utility room. The agent says hesees a blanket and as he pulls it out of the dryer a gun, glove, and shellcasing falls on the floor.Agents did not take one picture of the shell casing on the floor -a very critical piece of evidence. Once they found out the dryer contained what agents believe to becritical evidence, they did notfingerprint the dryer.”This is some of why I think evidence will show this was a rush tojudgement case.”"The state tells you theyfound Becky Bryan’s DNA in a glove in her own house, a work glove and thats she’s the majorcomponent. Well, the the minor component matched Keith Bryan.”OSBI also gathered clothes that becky had on that evening and theychecked her clothing for blood, blow back (you will hear blow back is matterthat would come back on you during a shooting). They did not find any on BeckyBryan.OSBI did not collect thehair from when it was shaved from Keith Bryan at the hospital which could havebeen critical evidence. Also, a box of Blazer Brass (a box of bullets) was found in thebedroom. Investigators say 4 rounds were left in gun, 1 round left in the chamber, and 1 roundstruck Keith Bryan. That’s 6 rounds right there. They say the box had 45 bullets left init, so of the Blazer Brass – we have 51bullets?Also, you will hear that on September 22, following a breakingnews report, JW Jones , an ex-Clinton& ex-Mustang officer hears there is a possible small blue or black pickupthat was involved in a shooting in Mustang a little after 10pm on September20th. Thats when he realize somethinghe witnessed was very important. JW Jones told 2 OSBI agents – he left his sisters house, 2/3 ofmile from Czech Hall, he texted his girlfriend before leaving. It was around10:05pm when he heads for home. He isheading East on SH152 when he gets close to Czech Hall he notices a vehiclecoming up quick on him. The vehicle almost strikes a Silver Sedan. All this caught his eye. He says this smallblue or black ford ranger is crowding a car trying to get through theintersection. He says I kinda wanted to look over and see. So, he looks overand he is able to see the driver, awhite male medium build with a long sleeve sweatshirt pulling a hat or hoodieup over his head.Jones reports this to the OSBI on September 22nd. Two businessesin the area have cameras but no one goes to check the surveillance. What Jones told OSBI was not written in a report until April 4,2013, just a couple weeks ago.Break for Jurors – just before 11a.m.STATE CALLS FIRST WITNESS – DEBBIE PROCTOR – BECKY BRYAN’S FRIENDOn July 2010, Becky sold me my condoWe just really clicked and got along and became friends and wewent to lunch.Did you ever go to her house yes how frequently several times a weekKeith – her husbandDid you know Keith before you bought the house from the defendant? no Would you describe your relationship with Keith to be any morethan with Becky? no Did you socialize with him? yesDid you socialize with keith outside of residence? no Enters State Exhibit 1 – photograph of Keith BryanSeptember 20, 2011 – was Proctor’s last time at the residenceWhat time did you arrive ? probably around 8:45You went on a date? yes, at Chili’sDid you have plans to go to Bryan residence? no How did it come about? several witnesses at hospital said that the intruder came in the back door.when you are going in garage area were you worried about contaminating the scene.did you know before you went in that it was suspected the intruder left did chief folley tell you becky was a suspect? stigma normally associated with such borrowing. It was one of several innovative lending mechanisms the central bank created to keep at least some credit flowing during a deepening crisis.”I will remember Chairman Ben Bernanke as an individual who – in the midst of very stressful circumstances – led the Fed in taking bold, decisive, and creative actions to avoid a global financial catastrophe,” said Dana Saporta, senior economist at Credit Suisse. The enormity of what lay ahead would not crystallize until 2008, when U.S. investment firms came under speculative attack. Only two of the five biggest, Goldman Sachs and Morgan Stanley, survived – and only because of taxpayer support. The bank bailout generated a powerful public backlash. Critics charged that the bank aid was not matched by similarly aggressive rescues for troubled homeowners or jobless Americans. But Bernanke, drawing insights from his Princeton research, argued that rescuing the financial system was central to saving the economy. His main academic focus, sparked by the experiences of his small businessman grandfather, was the central role of the Fed in creating the Great Depression when it kept monetary policy too tight and allowed banks to fail en masse. As Bernanke rewrote the rules on providing liquidity to parched financial markets, he also led an historic easing of monetary policy.By December 2008, the Fed had brought overnight interest rates down to effectively zero for the first time in its 100-year history. It then further pushed down borrowing costs with three rounds of bond purchases that have quadrupled its balance sheet to a record $3.7 trillion.Bernanke’s efforts were recognized when Time Magazine named him as “Person of the Year” in 2009, dubbing him “the most powerful nerd on the planet.”But the unconventional policy attracted critics, including those who argued it risked fanning inflation or creating asset price bubbles – concerns yet to be substantiated. When Bernanke came up for reappointment to a second four-year term in January 2010, the Senate confirmed him on a tepid 70-30 vote, the narrowest margin in the position’s history. Both Democrats and Republicans assailed his leadership, blasting him for the unpopular $182 billion taxpayer bailout of insurer American International Group and for regulatory failures that fueled the crisis. Many criticized the bank’s closeness to Wall Street.By his own admission, Bernanke failed to predict the housing bubble fall-out. In March 2007, he told Congress that “the problems in the subprime (mortgage) market seem likely to be contained.” Several other times he expressed optimism about the financial system’s soundness.RECOVERY NOTAnother Bernanke legacy will be his push for greater Fed transparency, particularly in convincing his colleagues to adopt a numerical inflation target. He also created a more collegial, less hierarchical central bank than the one Greenspan left behind.”One of the things that I hoped to accomplish and was not entirely successful at … was to try to depersonalize, to some extent, monetary policy,” he told reporters in March 2013.Bernanke might prefer to leave with the nation on a more solid economic footing but reality has not cooperated. U.S. unemployment remains high at 7.3 percent and labor force participation continues to decline. There also are doubts about the Fed’s rosy 2014 growth forecasts given a deteriorating global outlook, with rising tensions in key emerging markets such as India.Fed officials’ faith in the recovery’s strength is sufficiently weak that they surprised markets with a decision not to begin cutting back bond purchases in September. That sparked criticism about the Fed’s communications – despite Bernanke’s transparency drive. Some now see the decision as prescient given fresh clouds of economic uncertainty from a federal government shutdown and a political standoff over raising the nation’s $16.7 trillion debt ceiling that could lead to a default.(Additional reporting by Alister Bull; Editing by Krista Hughes, Marilyn W. His debut single “Suit & Tie” featuring rapper Jay Z became a chart-topper in January, and his album was received well by fans and critics.Other new albums in the top 10 this week include 16-year-old New Zealand singer-songwriter Lorde at No. 3 with her debut album “Pure Heroine,” selling 129,000 copies. The album has been driven by the popularity of the single “Royals,” which topped Billboard’s digital songs chart this week, selling more than 2 million download copies in the United States. Lorde’s album also garnered nearly 6 million U.S. plays on online streaming platform Spotify in its first week.Country singer Tyler Farr entered the chart at No. 5 with his debut album “Redneck Crazy,” while Los Angeles sister trio Haim came in at No. 6 with the critically acclaimed debut album “Days Are Gone.”On the digital songs chart, which measures song downloads, the top three songs remained steady this week with Lorde’s “Royals” at No. 1, Katy Perry’s “Roar” at No. 2 and Miley Cyrus’ “Wrecking Ball” at No. 3.A surprise entry on the digital songs chart this week came in the form of British 1960s rock band Badfinger’s “Baby Blue” at No. 32. The song scored 37,000 downloads in the past week after being featured in the closing scene in the final episode of AMC’s drug drama “Breaking Bad” last month.Overall, album sales for the week ending October 6 totaled 4.8 million, down 10 percent from the comparable week in 2012, according to Billboard.(Editing by Eric Kelsey and Stacey Joyce)Time not on the side of older Americans in housing slumpCHICAGO (Reuters) – Prior to 2008, many baby boomers assumed they were set for retirement. They would fund those golden years by tapping into their homes if they hadn’t saved enough in their 401(k) plans. But home equity no longer looks like a safe Plan B for a fast-growing group of pre-retirees and seniors.About 3.5 million homeowners are “underwater” on their mortgages, meaning they owe more than their properties are worth, according to a report released last week by the AARP Public Policy Institute. The rate of foreclosures is lower for homeowners under age 50, while the 50+ population experienced a much higher rate of growth in foreclosures from 2007 to 2011.At the end of last year, 2.92 percent of mortgage loans to 50+ households had been foreclosed – a whopping 873 percent increase from 2007, AARP reported. By contrast, 3.48 percent of loans to younger households had been foreclosed, with a corresponding growth rate of 729 percent. The study adds to the growing mountain of evidence that the economy has shredded retirement possibilities, especially for low and middle-class households. Lower home values are especially devastating for these demographic groups. The Federal Reserve Bank reported recently in its triennial Survey of Consume Finances that housing accounted for 51 percent of household wealth for middle-income households, compared with just 19 percent for households in the top ten percent of income.HIGHEST ACTIVITYForeclosure activity remains high in many parts of the country, according to a report released today by RealtyTrac, an online marketplace for foreclosed properties. The report found that the number of foreclosures rose in 59 percent of the nation’s top metro markets.California accounted for 10 of the top 20 metro foreclosure rates during the first half of the year; Florida accounted for four of the top 20 metro foreclosure rates, and Illinois accounted for two of the top 20. Georgia, Arizona, Nevada and Colorado each had one city in the top 20.”Even if seniors are only a little underwater, that can be a big problem since they may be at a time when they want to make a move, and can’t easily sell,” says Andrea Alegria, an industry analyst specializing in real estate at IBISWorld. “They don’t have the benefit of time, which would allow them to wait for the property’s value to increase.”AARP found that 53 percent of foreclosures among homeowners over age 50 occurred on loans where borrower income was between $50,000 and $124,999; another 32 percent occurred where borrower income was less than $50,000. Last year, the foreclosure rate for Hispanics over age 50 was 3.9 percent and the foreclosure rate for African Americans was 3.5 percent – double the rate of 1.9 percent for whites.NO TIME TO WAITEven if a housing recovery does get underway, older homeowners who are underwater aren’t likely to have sufficient time to wait out a full recovery, which likely will take years, if not decades. About half (51 percent) of families headed by a person age 65 to 74 had no money in retirement savings accounts in 2010, according to Federal Reserve data. And among those with savings, half had less than $100,000. Among families headed by a person age 75 and older, 67 percent had no money in retirement savings accounts in 2010.”Many of these seniors are relying entirely on Social Security,” says Debra Whitman, executive vice president for policy at the AARP Policy Institute. That leaves many older adults with very limited options when mortgage problems surface. “Many will look to family members for housing – we are seeing a lot of multi-generational housing,” says Alegria. “Or they’ll rent.”Experts advise seniors facing foreclosure to seek counseling – but only from one of the network of free counseling services approved by the U.S. Department of Housing and Urban Development (HUD). A federal task force has been seeking to crack down on scams by fee-based counseling services that promise vulnerable homeowners that they can save their homes and lower their mortgage payments.”A lot of the fee-based services we think of as scams,” says Bruce Dorpalen, executive director of the National Housing Resource Center, a nonprofit organization advocating for housing counseling agencies. “They aren’t as well-connected or as effective as the HUD-approved counseling services.” HUD’s website offers a national directory of free counseling services (), which work with mortgage lenders to try to avoid foreclosure. Housing counselors also can help homeowners organize their finances and understand mortgage options. The department also offers a 24-hour housing foreclosure hotline (888-995-4673) that can provide foreclosure assistance. The new Consumer Financial Protection Bureau (CFPB) offers a useful page of advice and resources for consumers at risk of foreclosure on its website, including HUD-approved counseling and free legal services. But pollsters say many Americans plan to work well past that age, reflecting tough economic times and a general desire to reshape the idea of retirement. What will working longer mean for the Social Security benefits of these seniors? How about Medicare, which has filing rules that are closely linked to those of Social Security and employment status? These are important questions for a large portion of the U.S. population; about 10,000 seniors will turn 66 every day over the next 20 years. Social Security and Medicare both have detailed rules governing the interplay of work and benefits, and making the right decisions make a difference of thousands of dollars in enhanced Social Security benefits or the Medicare premiums that you pay.I’ll be looking at how work and entitlement benefits are intertwined in two columns, starting today with Social Security.Social Security’s rules encourage seniors to keep working at least until the Full Retirement Age (FRA) of 66. You can work and receive full benefits starting at that age. You can start receiving Social Security as young as 62, but if you’re working, $1 will be deducted from benefit payments for every $2 earned over $14,640. Although this is often described as a penalty, the withheld benefits are added back to your benefits, after you reach 66, using a complex actuarial formula.Social Security offers another important incentive to forestall filing until at least 66. Benefits are reduced permanently for every year that you file before the FRA, and increased for every year that you wait to file beyond it, up till the age of 70.That’s intended to keep the program actuarially fair, paying roughly equal lifetime benefits to everyone in the program. But delaying does deliver a major boost to monthly income – and it serves as an inducement to work longer and wait to receive benefits. For example, filing at 62 means you retired four years early, and the net effect is a permanent reduction in annual benefits of 25 percent. On the other hand, if you wait until age 70, your annual benefit will be 32 percent higher than if you started at age 66.Married couples can coordinate these decisions to boost benefits through smart navigation of Social Security’s survivor and spousal benefits rules. The survivor rules permit widows to receive up to 100 percent of a deceased spouse’s benefit or her own benefit, whichever is greater; the spousal rules permit receiving the greater of her own benefit or up to half of a living spouse’s benefit. The survivor rule has a very simple implication for retirement timing decisions: couples usually benefit when the spouse with the higher lifetime earning history (which translates into a bigger Social Security check) delays filing. That’s most often the man – and men can expect their wives to outlive them. A delayed filing by the higher-earning husband usually sets the stage for the widow to receive a higher benefit down the road, after his death. But that doesn’t mean couples must forego Social Security entirely while the husband delays filing, notes Jim Blankenship, a financial planner in New Berlin, Illinois and author of “A Social Security Owner’s Manual: Your Guide to Social Security Retirement, Dependent’s, and Survivor’s Benefits” ().Blankenship suggests that the lower-earning spouse files for her own benefit at 62, receiving the lower rate, or at her FRA. When the higher-earning spouse files to receive the increased, delayed benefits, the spouse is eligible to shift to the spousal benefit (again, based on half of the spouse’s benefit) in situations where that makes sense.”That brings in some benefits while the higher-earning spouse – usually the husband – keeps working and earning credits toward a higher benefit,” he says.Blankenship takes it one step further: He suggests that the higher-earning spouse files for a spousal benefit while he waits to file for his own benefits.”It’s not a lot of money in most cases, but it is money you’re entitled to and should receive,” he says.Another perfectly kosher maneuver is known as a “file and suspend.” Let’s say the higher-earning husband wants to continue delaying taking benefits past his FRA in order to keep accruing credits. But the lower-earning wife would like to file for spousal benefits on the husband’s record. Here’s how the “file-and-suspend” works:1. The higher-earning spouse files for benefits at his FRA but immediately files a notice to suspend benefits.2. The lower-earning spouse elects to receive spousal benefits3. The higher-earning spouse continues to accrue higher payments for whatever point he elects to begin receiving benefits. For more on the ins and outs of filing for benefits , see my guide to Social Security basics ( ) and an FAQ on spousal and survivor benefits ().In a future column, I’ll take a look at how Medicare’s filing rules and how they interact with employer-based benefits.(Editing by Bernadette Baum)Toilet glitch forces JAL to turn around Dreamliner flightTOKYO Oct 10 (Reuters) – Japan Airlines Co wasforced to turn around its Tokyo-bound flight from Moscow onThursday due to a problem in the Boeing 787 jet’slavatory, a spokesman for the Japanese carrier said. The incident on the 787 Dreamliner follows a spate ofproblems since its first flight in December 2009, including abattery fire that temporarily forced the grounding world-wide ofBoeing’s high-profile fleet.JAL spokesman Takuya Shimoguchi said the toilet malfunctionon the flight from Moscow was likely caused by an electronicglitch. The airline was working on repairs on the ground, headded. The flight, carrying 141 passengers, departed Moscow onWednesday evening and returned after about five hours, he said.Shares in JAL, which made headlines this week by signingwith Boeing rival Airbus for the next generation oflong-haul jets, were up 2.1 percent on Thursday morning, outperforming the broader market.Top court upholds healthcare law in Obama triumphWASHINGTON (Reuters) – The Supreme Court upheld President Barack Obama’s healthcare law on Thursday in an election-year triumph for him and fellow Democrats who championed the most sweeping overhaul since the 1960s of the unwieldy U.S. healthcare system. In a 5-4 ruling based on the power of Congress to impose taxes, the nation’s highest court preserved the law’s “individual mandate” requiring that most Americans obtain health insurance by 2014 or pay a tax. The justices also preserved, with some changes, a provision of the law expanding the Medicaid health insurance program for the poor. The decision – written by conservative Chief Justice John Roberts and joined by the court’s four liberals – was a setback for Republicans who mounted unified opposition in Congress to the law before its 2010 passage and who deride it as meddling in the lives of individuals and in the business of the states.Obama and Mitt Romney, the Republican challenger in the November 6 presidential election, immediately responded, with the president calling the ruling “a victory for people all over this country whose lives will be more secure because of this law and the Supreme Court’s decision to uphold it.”"We will continue to implement this law and we’ll work together to improve on it,” said Obama, speaking somberly in the White House East Room, the same setting he used to announce the 2011 death of al Qaeda leader Osama bin Laden.”What we won’t do – what the country can’t afford to do – is re-fight the political battles of two years ago or go back to the way things were. With today’s announcement, it’s time for us to move forward,” Obama added.Romney, who pushed through a similar healthcare overhaul at the state level in 2006 as governor of Massachusetts but opposed Obama’s law, called on voters to help him defeat the president in order to repeal the law critics derisively call “Obamacare.”"If we’re going get rid of ‘Obamacare’ we’re going to have to replace President Obama. My mission is to make sure we do exactly that,” Romney said on the roof of a building overlooking the U.S. Capitol. The healthcare law, known formally as the Patient Protection and Affordable Care Act, is the biggest overhaul of the $2.6 trillion healthcare system in about 50 years. It was signed by Obama in March 2010 and promptly put to the test in the courts by 26 of the 50 states and a trade group for small businesses. The court’s decision largely vindicates Obama and Democratic lawmakers in their attempt to fix a system that, while representing 18 percent of the economy, leaves 16 percent of Americans uninsured, a fact that sets the United States apart in the industrialized world. The U.S. system, unlike other rich countries, is a patchwork of private insurance and restrictive government programs. The United States pays more for healthcare than any other country, but about 50 million of the roughly 310 million Americans still have no insurance at all.The Obama law was meant to bring coverage to more than 30 million of the uninsured and slow soaring medical costs.Roberts was joined by liberal Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan in upholding the law’s pivotal “individual mandate” provision. The four dissenters, all from the court’s conservative wing – Justices Antonin Scalia, Anthony Kennedy, Clarence Thomas and Samuel Alito, took the unusual step of issuing one joint opinion and said they would have struck down the entire law.Kennedy, summarizing the dissent from the bench, accused the court majority of “vast judicial overreaching. It creates a debilitated, inoperable version of healthcare regulation that Congress did not enact and the public does not expect.”‘CHARACTERIZED AS A TAX’Opponents said the individual mandate was an overreach by the federal government and that Congress had exceeded its powers. The court was deeply divided on this issue, but the majority ruled that Congress’s taxing authority allowed the mandate. The law’s “requirement that certain individuals pay a financial penalty for not obtaining health insurance may reasonably be characterized as a tax,” Roberts wrote for the court’s majority.”Because the Constitution permits such a tax, it is not our role to forbid it, or to pass upon its wisdom or fairness,” Roberts wrote. In another part of the decision, the court said Congress went too far in a part of the law that requires states to expand the government’s Medicaid health insurance program for the poor with the goal of covering more of the uninsured. The court said this problem can be fixed by precluding the federal government from stripping states of existing Medicaid funds if they did not comply with the expansion, and that this did not require striking down other parts of the law.DRAMATIC DAY AT COURTThe court began its session much as it always does. At 10 a.m. sharp, the marshal’s familiar cry of “Oyez! Oyez! Oyez!” rang out as the nine justices entered through heavy scarlet drapes and took their seats at the tall mahogany bench. The looks on their faces gave nothing away. As he took a seat, Chief Justice Roberts smiled slightly in the direction of the justices’ guest seats, where his wife, Jane, was sitting. As he and other justices read statements, it became obvious that Roberts, appointed by Republican President George W. Bush in 2005, had been the crucial vote upholding Obama’s law.Roberts showed he had taken control over a divided bench. He highlighted flaws in the administration’s arguments and stressed the majority was not commenting on the wisdom of the law.Rather, he said, if it could be upheld, the court must uphold it. He said it was not the job of the judiciary “to save” the nation from policy choices made by elected legislators.Romney and the Republicans had hoped the Supreme Court would gut the law. Deprived of that outcome, they can now continue pressing the attack on Obama on the campaign trail, but their hopes for a rollback or repeal will hang on legislation, unlikely before the elections, and on the voting public, whose views are mixed.”What the court did today was say that Obamacare does not violate the Constitution,” Romney said. “What they did not do is say that Obamacare is good law, or good policy.”About 56 percent of Americans said they opposed the law in a Reuters/Ipsos poll released on Sunday. When asked about its individual provisions, however, most respondents said they strongly supported them, except for the individual mandate, which was opposed by 61 percent of those surveyed. Most respondents in the survey favored banning insurers from denying coverage to people with pre-existing conditions; letting young adults stay on their parents’ insurance plans until age 26; and making companies with more than 50 workers offer insurance to their employees. All are parts of the law.So are the creation of state-based exchanges to offer health insurance; insurance premium assistance to poor people; and insurance tax credits for those just above the poverty line.Jamie Thompson of Harleysville, Pennsylvania, who has a daughter with cystic fibrosis, welcomed the ruling.”My daughter’s healthcare costs a fortune. She’s 10. We haven’t gotten to the end of the line, but we’ve been told it’s not uncommon for cystic fibrosis kids to discover they’ve used up their lifetime benefit from healthcare,” he said. “It means she will have healthcare when she needs it.”House of Representatives Speaker John Boehner, the top Republican in Congress, said, “Today’s ruling underscores the urgency of repealing this harmful law in its entirety.”Eric Cantor, the No. 2 Republican in the House, said the House would vote on July 11 on legislation that would repeal the law. The Democratic-led Senate is certain to block any repeal legislation coming out of the Republican-controlled House.Democrats hailed the court ruling as a posthumous victory for a longtime healthcare reform champion, Senator Ted Kennedy, who died in 2009. House Democratic leader Nancy Pelosi said she called his widow Vicki Kennedy to say: “Now, Teddy can rest.Shares of hospital chains jumped, while large health insurer stocks fell after the ruling. Widening the pool of paying patients stands to benefit hospitals, which are often left to cover the high medical bills of the sick who have no coverage.(Additional reporting by David Morgan, Donna Smith, Deborah Charles, Thomas Ferraro, Jeff Mason, Alister Bull and Laura MacInnis in Washington with Lewis Krauskopf in New York and Julie Steenhuysen in Chicago; Writing by Kevin Drawbaugh; Editing by Howard Goller and Will Dunham)Top SEC lawyer on ‘Fabulous Fab’ trial to join WilmerHaleNEW YORK (Reuters) – Matthew Martens, the top trial lawyer at the U.S. Securities and Exchange Commission who led the agency to victory in its blockbuster civil fraud case against Goldman Sachs Vice President Fabrice Tourre, is joining the law firm Wilmer Cutler Pickering Hale and Dorr. The law firm, known as WilmerHale, announced on Wednesday that Martens will be joining as a partner in its securities and litigation practices.Martens most recently served as chief litigation counsel for the Division of Enforcement at the SEC. Although his main job was to oversee other lawyers, he tried the case against Tourre, the highest profile case to emerge from the agency’s investigations into the causes of the 2008 financial crisis. The SEC had accused Tourre, who once referred to himself as “the fabulous Fab” in an email, of misleading investors in a synthetic collateralized debt obligation called Abacus 2007-AC1. The SEC said Tourre failed to disclose that Paulson & Co Inc, the hedge fund of billionaire John Paulson, helped choose subprime mortgage securities linked to go into Abacus and also that the fund planned to bet against it.Martens joined the SEC in August 2010 from the U.S. Attorney’s Office in Charlotte, North Carolina, which he joined as an assistant U.S. Attorney and left as a deputy criminal chief.WilmerHale, which represents major corporations, has 1,000 lawyers across 14 offices in the United States, Europe and Asia, according to its website.(Reporting by Andrew Longstreth and Sarah Lynch; Editing by Lisa Shumaker)Top shareholders back Alibaba’s controversial corporate structure(Reuters) – Alibaba Group’s biggest shareholders have backed a partnership structure that is at the center of a debate over where the Chinese e-commerce giant may list its shares in the most highly anticipated Internet IPO since Facebook Inc’s $16 billion offer last year.Alibaba, which analysts value at as much as $120 billion, appears to have failed to convince Hong Kong regulators to waive tough listing rules, potentially handing the lucrative IPO to rival U.S. market operators.Founded by billionaire entrepreneur Jack Ma, Alibaba wants to find a home for its stock where its 28 partners, mainly founders and senior executives, can keep control over a majority of the board, even though they own only around 13 percent of the company. In the first public comments from one of those partners, Executive Vice Chairman Joseph Tsai defended Alibaba’s corporate structure on Thursday, saying it is a “living body” intended to preserve the company’s culture. While losing such a large IPO would be a blow to the Hong Kong stock exchange – Alibaba could seek to raise as much as $15 billion in the initial public offering – regulators there have stood firm in their defense of small investors and a policy of treating all shareholders alike.”We understand Hong Kong may not want to change its tradition for one company, but we firmly believe that Hong Kong must consider what is needed in order to adapt to future trends and changes,” Tsai, one of Alibaba’s 18 founders in 1999, wrote in a blog post. ()On Friday, Alibaba received the backing of both Japanese wireless carrier SoftBank Corp and Yahoo Inc, its two largest shareholders with stakes of 36.7 percent and 24 percent, respectively.”Alibaba has built a phenomenal business and created tremendous value for its shareholders over the years,” SoftBank CEO Masayoshi Son said in a statement. “We are therefore very supportive of the Alibaba partnership structure.”In a brief statement, Jacqueline Reses, Chief Development Officer at Yahoo and an Alibaba board member, said: “In a fast-moving technology market, it’s critical that a company’s leadership can continue to preserve its culture and set its strategic course for the future.”"As one of Alibaba’s largest shareholders, Yahoo believes that management’s efforts reflect the desire to govern the company for long-term success while also balancing the rights of shareholders.”STRONG DEFENCETsai’s defense of Alibaba’s partnership model comes as debate rages in Hong Kong about whether the Asian financial hub should be more flexible to attract new and emerging companies.Hong Kong Exchanges and Clearing Ltd (HKEx), which is both the regulator of new listings and a publicly traded company that benefits from IPO fees and subsequent stock trading volumes, has insisted that its first duty is to protect all shareholders. In a lengthy blog post this week, the exchange’s CEO Charles Li suggested maybe leaving open the door to potential rule changes, so long as discussions aren’t rushed. He did not directly name Alibaba in his commentary.Hong Kong’s failure to secure the Alibaba IPO would mean lost revenues and less marketing clout to attract other deals. Alibaba commands 80 percent of China’s e-commerce market and handled 1 trillion yuan ($163.4 billion) of goods last year through its Tmall and Taobao market platforms.”The question Hong Kong must address is whether it is ready to look forward as the rest of the world passes it by,” Tsai wrote. “As a company with most of our business in China, it was natural for Hong Kong to be our first choice.”"Those who lack appreciation of our partnership philosophy may view o
